TERMS + CONDITIONS

1. Introduction

Welcome to Kobe & Co. Creative LTD (“we,” “us,” “our”).
These Terms & Conditions govern your use of our services, website, deliverables, and any associated communications. By engaging with us, you agree to these terms. If you do not agree to these Terms, please refrain from using our services.

2. Services Provided

Kobe & Co. Creative LTD provides creative marketing services, including but not limited to:

  • Brand strategy & development

  • Creative direction

  • Social media content creation

  • Campaign development

  • Copywriting

  • Graphic design

  • Digital marketing consulting

  • Additional services as mutually agreed upon in writing

  • All services will be outlined in a proposal or agreement before work begins.

3. Project Scope & Revisions

Each project includes a clearly defined scope in the proposal. Revisions will be outlined in the proposal (e.g., two rounds of revisions unless otherwise agreed).

Additional revisions or work outside the scope may incur extra charges at our standard hourly or project rate. Any changes requested after work has begun may impact timelines and pricing.

 

4. Payment Terms

A deposit (usually 20% unless stated otherwise) is required to secure your project. Remaining balances are due upon completion of the project or according to the agreed payment schedule. Work will not commence until the deposit is received.

Final deliverables will not be released until full payment is made. Late payments may incur fees after 7 days past due, unless otherwise arranged.

Payment methods accepted: bank transfer or other options agreed upon in writing.

5. Cancellations & Refunds

Deposits are non-refundable, as they secure time and project resources. If a project is cancelled after work has begun, you will be billed for work completed up to the cancellation date. If we must cancel a project due to unforeseen circumstances, you will receive a refund for any incomplete work not yet delivered.

6. Deadlines & Turnaround Times

Project timelines depend on prompt client communication, feedback, and approvals. Delays in receiving necessary materials or approvals from the client may push deadlines. Rush projects may incur additional fees.

 

7. Client Responsibilities

You agree to:

  • Provide accurate and timely information required for the project

  • Respond to communications and approvals within the agreed timeframe

  • Supply all necessary logins, brand assets, and content promptly

  • Ensure any materials you provide do not infringe on third-party rights

 

8. Intellectual Property
Ownership Before Final Payment: Kobe & Co. Creative LTD retains full ownership of all creative work until the project is paid in full.

Ownership After Final Payment: Once full payment is received: You receive the rights to the final approved deliverables for their intended use.

Raw working files (PSD, AI, video project files, etc.) are not included unless otherwise specified or purchased.

Agency Portfolio Rights: We reserve the right to showcase completed work—including logos, websites, campaigns, graphics, and results—in our portfolio, website, social channels, and promotional materials unless a separate NDA has been signed.

 

9. Confidentiality

Both parties agree to keep confidential any private or proprietary information shared during the project. This includes internal processes, strategies, and data not intended for public release.

 

10. Limitation of Liability

We are not liable for:

  • Business losses or damages resulting from the use of our deliverables

  • Technical issues caused by third-party platforms or software

  • Delays due to factors outside our control

  • Any misuse or unauthorized modification of deliverables after handoff

  • Our total liability will not exceed the amount paid for the project in question.

11. Third-Party Tools & Platforms

Some services may require the use of third-party software, tools, or subscriptions (such as ad platforms, scheduling tools, analytics tools, etc.).

Clients are responsible for associated fees unless otherwise agreed. We are not responsible for outages, platform changes, or issues stemming from third-party services.

 

12. Termination

Either party may terminate the agreement/contract with 30 days written notice.

14. Updates to These Terms

We may update these Terms from time to time. The most recent version will always be posted or provided upon request.
